It’s official. Smoking is no longer allowed in most enclosed employment and public places in Liberty, including bars and restaurants. The Liberty City Council voted unanimously to certify the results of the Nov. 3 election at its meeting Nov. 23, triggering a change in ordinances. In official totals, the issue received 2,684 yes votes and 1,127 no votes, for a voter approval of 70 percent. The referendum needed a simple majority for passage. Under the new ordinance, smoking is allowed on outdoor patios, in 25 percent of hotel and motel rooms and in designated areas in city parks. Marge Sambursky, owner of Retro Bowl, asked if the council would give her time to provide an area for smokers, but Mayor Greg Canuteson said the council had no such authority. Under the old ordinance, bowling alleys were exempt from the smoking ban. “The voters have spoken,” Canuteson said. Smokers and owners of businesses that allowed smoking could be fined if found guilty of violating the ordinance. Fines range from $50 for a first offense to $500 for a third or subsequent violations.

A smoking ban means it is against the law to use or permit a legal product on 'private' property.

"Most of the people voting in a referendum are not the people who regularly support the bars and restaurants day in and day out. Why should these people make the decisions that should be made by the owners, staffs, and patrons about using a legal product on private property?"
