A hearing to determine if the proposed Clay County constitution will be placed before voters on the Nov. 5 ballot has continued into a second week.

The case is being heard before Judge Roger Prokes of the 4th Judicial Circuit Court in Nodaway County. Prokes will rule on the case on special assignment after members of the Clay County Circuit Court recused themselves because they had appointed members to the Clay County Constitution Commission that drafted the constitution proposal.
